Legal warranty vs. guarantee
Sicherheitab 9 J.
The legal warranty is your statutory right (2 years, the seller is liable). A guarantee is a voluntary service offered by the manufacturer. Both protect you against defects.
The two terms are often confused, but they are fundamentally different:
Statutory warranty (Gewährleistung):
• Duration: 2 years from purchase
• Claim against: the seller (not the manufacturer)
• Content: the seller must remedy a defect free of charge
• Proof: in the first 12 months the seller has to prove that the defect didn't exist at the time of purchase
Guarantee (Garantie, voluntary):
• Duration: freely chosen by the manufacturer (1–5+ years)
• Claim against: the manufacturer
• Content: varies – often repair or replacement
• In addition: comes on top of the statutory warranty
Did you know? The statutory warranty (2 years) is a RIGHT that cannot be excluded. A guarantee is a VOLUNTARY service from the manufacturer.
