Inheritance contract

ErbschaftErwachsene
A contract between the testator and heirs – binding on BOTH sides. Unlike a will, an inheritance contract cannot be changed unilaterally. In Germany it must be notarised.

An inheritance contract (Erbvertrag) is a binding agreement on the distribution of the estate – unlike a will, which can be changed at any time.

Difference from a will:

• Will: can be changed or revoked unilaterally at any time
• Inheritance contract: binding for all parties. Changes only with the consent of ALL

When does it make sense?

• Patchwork families: clear rules for children from different relationships
• Business succession: the heir takes over the company under certain conditions
• Care agreement: "You look after me, and in return you inherit the house" – as a binding contract

Mandatory: notarial certification in Germany (cost: depends on the value of the estate, from approx. €200). Without a notary: invalid!

Caution: an inheritance contract severely restricts your freedom of disposition. Think carefully about whether you want to commit yourself for so long.

Did you know? Unlike a will, an inheritance contract CANNOT be changed unilaterally. Only about 5% of estate arrangements in Germany are made by inheritance contract.
