Notary

ImmobilienErwachsene
Mandatory when buying property in Germany: the notary certifies the purchase contract, registers the land charge and handles the transfer of ownership. Cost: about 1–1.5%.

A notary (Notar) in Germany is an independent lawyer appointed by the state who notarises legal transactions, making them legally binding.

When do you need a notary (mandatory)?

• Buying property: the purchase contract MUST be notarised
• Land charge: entry in the land register
• Setting up a GmbH (limited company): articles of association
• Marriage contract: only valid with a notary
• Inheritance contract: notarisation mandatory
• Land transfers: gift, division

Costs (GNotKG):

Notary fees are set by law and can NOT be negotiated. Every notary charges exactly the same fees.

• Buying property for €300,000: approx. €2,500–3,500 (notary + land registry)
• Setting up a GmbH: from approx. €700
• Marriage contract: from approx. €500 (depending on assets)

Important: the notary is obliged to be neutral – they DON'T represent either party, but make sure both sides understand the legal consequences.
