Getting your deposit back

Alltagab 9 J.
How to get your rental deposit (often €1,500–3,000) back after moving out: know the deadlines, document the flat, write to the landlord.

How to secure your deposit (Germany):

Before moving out:

• Hand over the flat swept clean (don't renovate unless the tenancy agreement validly requires it)
• Take photos of every room (proof of condition)
• Draw up and sign a handover report with the landlord

After moving out:

• The landlord has 3–6 months to repay (review period)
• Part may be withheld until the next service charge statement
• Deductions only for REAL damage (normal wear and tear is at the landlord's expense)

If the landlord doesn't pay: request it in writing with a deadline (2 weeks). Then get a tenants' association involved or, if necessary, take legal action.

Did you know? Many “redecoration clauses” in German tenancy agreements are invalid! The Federal Court of Justice has ruled that rigid deadlines (“repaint every 3 years”) are void. You often do NOT have to redecorate when you move out.
